The Corporate Investigations practice group conducts inquiries involving fraud, accounting irregularities, embezzlement, regulatory violations, information leaks and other misconduct. Our team of attorneys, which includes a former prosecutor, brings a wide range of commercial litigation and trial experience to these complex and sensitive corporate matters.

We recognize that conducting internal investigations requires much more than a series of employee interviews. Evidence of wrongdoing may be found through a variety of sources, including former employees, vendors, clients and other outside parties. This evidence also may exist in documents maintained outside our clients’ offices. Kane Kessler uses a comprehensive approach to conducting investigations, which includes the following:

A complete analysis of all facts presented

Devising an investigative strategy and plan

Retrieving documentary evidence, including the preservation and recovery of electronic files

Identifying and interviewing all potential witnesses

Identifying, interviewing and confronting targets of the investigation

When necessary, we will assemble a case file for referral to an insurance company, regulator or law enforcement agency. We will also advise our clients on the best procedures for preserving evidence, sanctioning employees and vendors, and negotiating with regulators and prosecutors.

In addition to conducting the investigation, we offer legal services and advice to help mitigate the damages associated with an incident. This includes advising on financial and operational business controls and recommending procedures to safeguard against future problems.
