Litigators Obtain Dismissal for Landlord Client of Suit for Commercial Brokerage Fees
On September 9, 2024, the Firm successfully obtained dismissal on behalf of its commercial real estate client of a real estate broker’s breach of contract claim seeking a $225,000 brokerage commission. The Court ruled that the clear and unambiguous terms of the brokerage agreement at issue did not entitle the broker to a commission for renewal of the lease, which occurred more than 360 days after termination of the agreement with the broker. The Court also dismissed the broker’s quantum meruit and unjust enrichment claims as duplicative of the breach of contract cause of action.
