Firm Obtains DOJ Antitrust Clearance on Behalf of Advertising Trade Association

Kane Kessler successfully obtained clearance from the United States Department of Justice on behalf of AICP, a commercial production trade association, to develop and market an online platform that connects advertisers with media production companies to produce commercials for broadcast and cable television, the internet and other media platforms. The online platform product facilitates a bidding process, where production companies can lodge a bid for an advertiser’s project. Since exchanging price and other competitive information can facilitate anticompetitive coordination among competitors, Kane Kessler requested a written opinion from the DOJ regarding the impact federal antitrust laws may have on the platform. The DOJ found safeguards in the system that will keep competitive data secure and therefore stated the DOJ’s intentions not to challenge the development or use of the online platform.  Kane Kessler, P.C. is general counsel to AICP.  The attorneys on the matter were Robert L.
