Subpoena Seeking Internal Investigation Materials Quashed, Citing Attorney Client and Work Product Privileges
The Firm’s Litigation and Labor and Employment groups in March 2019 successfully obtained the quashing of a subpoena seeking employee interview notes and a client memorandum prepared by Kane Kessler for its hospitality client as part of an internal investigation. The Supreme Court of the State of New York held that the materials were absolutely protected from disclosure under the attorney-client and attorney work-product privileges, and provisionally protected as materials prepared in anticipation of litigation. The attorneys on the matter were Lois M. Traub and Jonathan M. Sabin.
