Preliminary Injunction Sought Against Kane Kessler Clients Denied

On November 22, 2024, the Orange County Supreme Court in California denied a motion for a preliminary injunction brought by a plaintiff who accused two Kane Kessler clients of orchestrating a fraudulent transfer to place assets out of the reach of the plaintiff creditor.  Among other things, the Court found that plaintiff failed to make a showing of imminent harm in the absence of injunctive relief and failed to show a likelihood of success on the merits because it was unable to demonstrate that the transaction was not for “reasonably equivalent value.”  Jeffrey H.
