On February 28, 2020, Judge Caproni of the Southern District of New York issued a 25-page decision granting a motion on behalf of the firm’s client to dismiss an amended complaint for shareholder derivative and individual claims based on breach of fiduciary duty, violations of the corporate charter and by-laws, waste and mismanagement, breach of contract and whistleblower retaliation under the Dodd-Frank Act.
